Since September 30, 1996, any person convicted of misdemeanor domestic violence, regardless of when the conviction occurred, cannot possess a firearm. This is the effective date for an Amendment Congress passed to the Federal Gun Control Act of 1968, making it a felony for a person with a state misdemeanor conviction for domestic violence to possess a firearm. The statute is 18 U.S.C. 922 (g) (9). The possible penalty is up to 10 years in state prison. Prior to the amendment the ban only applied to those with a felony conviction or those which involved contempt of an order of protection.
